Description
Kevin Ackhurst is a partner in the Competition & Foreign Investment Group. He has over 20 years of extensive experience providing timely and practical advice to help businesses navigate the Canadian regulatory processes involved in mergers and acquisitions, joint ventures and strategic alliances. Kevin advises on civil and criminal competition law matters, including abuse of dominance, cartels, competitor collaborations, mergers, misleading advertising, and pricing and distribution practices. To assist clients in staying onside the Competition Act, Kevin develops and helps implement competition law compliance programs for large and small organizations. Kevin also advises clients on the review of foreign investments under the net benefit and national security provisions of the Investment Canada Act.
Kevin works with Canadian and international clients across a broad range of industries, including aerospace, agribusiness, automotive, consumer products, energy, film, video, publishing and recorded music, financial services, mining, newspaper, oil and gas, pharmaceuticals, specialty chemicals, telecommunications and transportation. He is consistently recognized for his prominent position in the Canadian antitrust legal landscape by global and domestic directories, including Chambers Canada, Chambers Global, Best Lawyers in Canada and Lexpert.
Kevin is an active contributor to many publications, including Lexology GTDT’s Pharmaceutical Antitrust and Market Intelligence – Merger Control “Canada” chapters, the “Substantive Merger Review” chapter in the Canadian Bar Association National Competition Law Section’s Fundamentals of Canadian Competition Law, and the Competition Law Economics practice note for Thomson Reuters Practical Law. He also frequently comments on competition and foreign investment matters on his Twitter profile, @CanadaAntitrust.
Professional Activities
Kevin is an active member of the Canadian Bar Association (National Competition Law and Foreign Investment Review Section), where he was Chair (2017-2018) and Vice-Chair (2015-2017) of the Foreign Investment Review Committee, as well as Chair (2012-2013) and Vice-Chair (2010-2012) of the Mergers Committee. He was an adjunct professor at Western University Law School in Competition Law.
Background
In 2002-2003, Kevin was seconded to the International Affairs Division of the Canadian Competition Bureau. One of his primary responsibilities was supporting the chair of the International Competition Network steering group. Among other responsibilities, he prepared ministerial briefing notes, undertook international benchmarking studies, and participated in interdepartmental meetings on the interplay between trade and competition law.
Prior to joining Stikeman Elliott, Kevin was Head of the Canadian competition team at an international law firm.
